Salient feature of R.T.E.

*This act not only strictly prohibits to give / take any kind of donation or contribution or payment in connection with
admission of a child in any school but also stands dead against the “Screening Procedure” means method of selection for
admission after than random method.
That is, every child of the age of 06 - 14 years shall have a right to free and compulsory education in a
neighborhood school till completion of elementary education even after 14 years too.
On the after hand, where a child above 06 years of age has not been admitted in any school or through admitted,
could not complete his or her elementary education, then he or she shall be admitted in a class appropriate to his or her age.
Again, if a child is required to move from one school to another, then such child shall have right to seek transfer
certificate and the authority concerned shall remain bound to issue his / her T/C immediately.
Mention may be made that delay in producing T/C for any reason whatsoever shall not be a ground for either
delaying or denying his / her admission in such other school.
Another important matter to note that for the purposes of admission to elementary education, the age of a child shall
be determined on the basis of the Birth Certificate or parent’s declaration, as the case may be, that is no child shall be
denied admission in a school for lack of age proof and neither any child admitted in a school shall be held back in any
class or expelled from school till the completion of elementary education nor any child shall be subjected to physical
punishment or mental harassment.
Further, there is a SMDC consisting of elected representatives amongst whom at least 3/4 of members shall be
from parents/ guardians and 50% of members of such committee shall be women to look after the various development
works of the school.
If anybody contravene the said provisions, the guardian can move before the various appeal ate bodies for justice.
As such it is the duty of every parent/guardian to admit his / her child to an elementary education in the
neighborhood school not only in the interest of their own but in the greater interest of the society too.
